Civil Procedure
The complainant must lay charges against the person alleged to have violated forum law in the topic designated for complaint within the Hall of Justice.
A Judicator must then approve or dismiss the charges. A Judicator may not approve charges that they have laid themselves, although they may submit charges against others.
If the charge is dismissed by an administrator or moderator the procedure ends there.
If the charge is accepted by a Judicator the dispute moves to trial.
In the trial, the plaintiff (the person who lodged the complaint) must prove that they were correct in pressing the charges and that the accused is indeed guilty. The plaintiff may have another forum member represent them if the representative is willing. The defendant or accused (person being charged with an offense) will argue that they are innocent or otherwise plead guilty, automatically accepting the punishment. They may seek representation in the same manner as the plaintiff.
The plaintiff begins with an introductory statement in which they state all of their points against the accused.
The defendant then either pleads guilty or not guilty. If they plead guilty, they are sentenced immediately according to the Code. If they plead not guilty, they must then present their own introductory statement in which they provide all of the arguments in their defense.
The plaintiff is then allowed a rebuttal of the defendant's statements. No new points that do not concern the defendant's introductory statement may be included here.
The defendant is then allowed a rebuttal of their own regarding the plaintiff's introductory statement; this is not a rebuttal of the plaintiff's rebuttal, and any arguments concerning the rebuttal will be discarded.
The defendant must again plead guilty or not guilty. If they plead guilty they are punished according to the Code. If they plead not guilty the trial continues.
A 3-day third party commentary period is open after the second plea. After this period, a 3-day voting period is conducted by the forum members to decide whether or not the defendant is guilty. If they are found not guilty, the procedure ends there. If they are found guilty, the defendant is punished according to the Code.
