The Code

Note: Offenses contained herein will be decided either through arbitration or through civil court procedure. Arbitrary offenses are punished directly by the Judicators, while civil offenses are heard before the court and will be judged by the forums as a whole.

Note: The Hobobox is exempt from all crime.

Arbitrary Offenses


Disrespect for the law

Definition: Should you disobey the procedures set forth by the law, you will be charged with this offense. This offense cannot be contested except in the case of absence or ignorance of the law.

Sentence: Disrespect for the law carries a maximum ban of 5 days at the discretion of the Judicators.


Severe spamming

Definition: Should you spam the forums beyond possible redemption, such as creating a great deal of topics that make absolutely no sense or posting many incoherent replies, you will be charged with this offense. This offense cannot be contested except in the case of account hijacking.

Sentence: Severe spamming carries a maximum ban of 3 days at the discretion of the Judicators.


Severe threatening

Definition: Should you threaten another member of the forums to an extent that is unreasonable and for no good reason, you will be charged with this offense. This offense cannot be contested except in the case of account hijacking.

Sentence: Severe threatening carries a maximum ban of 5 days at the discretion of the Judicators.


Civil Offenses


Breach of privacy

Definition: A breach of privacy has occurred when a member of the forums reveals something about another member that the other member does not wish to be known publically.

Sentence: Breach of privacy carries title replacement and avatar disablement for 5 days. In certain cases, it may warrant a 3-day ban at the discretion of the plaintiff.


Godmoding

Definition: Godmoding is the unlawful exertion of power within a roleplaying world. For example, godmoding includes, but is not limited to: controlling another person's character or nation, performing acts of 'invincibility', having insanely advanced weapons or technology for the era, having disproportionately powerful abilities, etc.

Sentence: Godmoding carries a fine of 15% of the defendant's zen if the defendant is found guilty, and a 5-day replacement of the defendant's avatar. The evidence will also be deleted and filed into the Judicator's logs.


Metagaming

Definition: Metagaming is using OOC knowledge IC. For example, if you know that your enemy is in a hidden underground base, and your character has not actually found that out, your character can not know this.

Sentence: Metagaming carries a fine of 10% of the defendant's zen if the defendant is found guilty, and a 3-day disablement of the defendant's avatar. The evidence will also be deleted and filed into the Judicator's logs.


Minor spamming

Definition: A minor amount of spam that is only slightly obtrusive. For example: replying in one phrase to several topics without contributing anything to the discussion, or posting a random string of letters.

Sentence: A minor spam carries a fine of 5% of the defendant's zen if the defendant is found guilty.


Severe flaming

Definition: Severe flaming is composing a post that contains next to nothing but insults and personal attacks.

Sentence: Severe flaming carries a fine of 10% of the defendant's gold, as well as a 3-day avatar replacement.


Misdemeanors

The following offenses carry a warning before they constitute disrespect for the law:

*Note A Judicator is the term used for a moderator or administrator in the Hall of justice

Non-Arbitrary Procedure

The complainant must lay charges against the person alleged to have violated forum law in the topic designated for complaint within the hall of justice.

A Judicator must then approve or dismiss the charges. A Judicator may not approve charges that they have laid although they may submit charges against others.

If the charge is dismissed by an administrator or moderator the procedure ends there.

If the charge is accepted by a Judicator the dispute moves to trial.

In the trial the plaintiff(person who lodged the complaint) must prove that they were correct in pressing the charges and that indeed the accused is guilty. The plaintiff may have another forum member in their place if the replacement is willing and asked the plaintiff. The defendant or accused(person being charged with an offense) will argue that they are innocent or otherwise plea guilty accepting the punishment. They may seek representation in the same manner as the Plaintiff.

The plaintiff begins with an introductory statement in which they state all of their points against the accused.

The defendant then either pleads guilty or not guilty. If they plea guilty they are sentenced immediately according to the code. If they plea not guilty they most then present their own introductory statement in which they provide all of the arguments I their defense.

The Plaintiff then is allowed a rebuttal of the defendants statements. No new points that do not concern the defendants introductory statement may be included here.

The defendant is then allowed a rebuttal of their own regarding the Plaintiffs introductory statement, this is not a rebuttal of the Plaintiffs rebuttal and this will be taken into account during the sentencing of the accused.

The defendant must again plea guilty or not guilty. If they plea guilty they are punished according to the code. If they plea not guilty the trial continues.

A 3 day third party commentary period is open after the second plea after which a 3 day voting period of guilty and non guilty is conducted by the forum members.If found not guilty the procedure ends there if found guilty the defendent id punished according to the code.

Arbitrary Procedure:

I the case of arbitrary offenses a forum member may lay charges or a Judicator may lay charges directly.

The Judicators listen to introductory statements and rebuttals in the same format as non-arbitrary offenses however no jury(forum wide vote) or third party comments are in the process.

The Judicators then have a vote on which the majority must agree that the accused is guilty for a sentencing to occur. Sentencing may vary based on the discretion of the Judicators.

Complaint outline (Arbitrary and non-arbitrary)

1. User Name of accused

2. List of alleged offenses the accused has committed

3. Where the alleged offenses have occurred

4. Thoughts on why the alleged offenses are wrong (optional)

Penalty Procedures

Fines: Fines are at first to be given over willingly however if a user refuses to pay it will be taken by force along with extra money or an alternative penalty or both. If somebody is unable to pay a fine an alternative penalty will be arranged

Other Penalties are implemented directly by the forum administration and therefore can not be avoided. If redundent penalties occur additional penalties will be added to compensate for the lack of jutice.

Whereas the Organization forums are based on Justice and With a mix of Freedom and Order. Everything is held accountable to reasonable extent.

Nobody is above the law.

Fundamental Freedoms:

1. Freedom Of Opinion, Thought and Belief
2. Freedom Of Speech
3. Freedom Of association & Peaceful assembly

Legal Rights:

1. Every forum member has the right to vote in civil matters within the allotted time.
2. Everyone has the Right to Justice as defined by the forum laws.
3. Everyone has the right to forum judgment or Judicator Judgment depending on the type of law before penalties can be invoked.
4. Any person feeling their forum rights or freedoms have been infringed upon may make a report in the Hall of Justice
5. Laws are laid out in the Code of offences

Enforcement:

1. Every forum member has the right to go along with prescribed penalties before penalties are forced upon them
2. If members resist penalties the Judicators must forcibly invoke the consequences.

Past Occurrences:

1. Nothing in this Charter is retroactive however it comes into effect the moment of its public release and will apply to all new content after that moment.
